These Terms govern your use of TalkFit ("the Service") and the rights and obligations between you and the operator of the Service. By using the Service, you agree to these Terms.
These Terms are an English translation provided for convenience. In case of any conflict, the Korean version prevails.
1. The Service
- The Service is an AI-assisted English learning web and mobile application.
- Main features: daily lessons, quizzes, XP / level / streak tracking, a leaderboard, sentence analysis and correction, audio file transcription, YouTube video-based learning, and text-to-speech.
- The Service can be used in guest mode without signing in, or with a Google account. In guest mode, learning records are stored only in the browser session and are lost when the tab is closed.
- The current release is a Beta. Features may be added, changed, or removed without prior notice.
2. Accounts
- Accounts are created through Google sign-in. The Service does not store a separate password.
- You are responsible for managing your own Google account and may not transfer or lend your account to anyone else.
- You may permanently delete your account at any time at Settings → Account → Delete Account (계정 삭제). Deletion removes your learning records, leaderboard entry, and account information, and cannot be undone.
- If deletion does not complete successfully, you may request it through the contact address below.
3. Your Obligations
- You must comply with applicable laws and these Terms.
- You must have the necessary rights to any text, audio file, or link you submit, and you are responsible for its content.
- You must not enter or upload other people's personal or confidential information.
- The Service is a learning aid and must not be relied upon for professional purposes such as interpretation, certified translation, legal, or medical decisions.
4. Prohibited Conduct
- Copying, distributing, reverse-engineering, or creating derivative works from the Service's source code, learning content, or design without permission
- Calling the Service or its AI APIs with automated tools (bots, crawlers, scripts)
- Circumventing or defeating usage limits, authentication, or access controls
- Placing excessive load on the servers or otherwise interfering with normal operation of the Service
- Impersonating others or manipulating leaderboard records by improper means
- Submitting content that is unlawful, obscene, violent, or that infringes the rights of others
- Using output obtained from the Service to develop a competing service or to train AI models
Violations may result in restriction of access or suspension or deletion of your account without prior notice.
5. Intellectual Property
- All copyright and other intellectual property rights in the Service's software, learning content (lessons, examples, explanations, quizzes), logo, design, and database structure belong to TalkFit.
- You are granted only a limited, non-transferable, non-sublicensable right to use the Service for personal, non-commercial learning purposes.
- You retain the rights to the content you submit, such as your text and audio. The Service processes that content only to the extent needed to deliver the feature you requested (analysis, correction, transcription, and similar).
- Third-party content such as YouTube videos remains the property of its respective rights holders, and you may use it only within the scope of personal study.
6. AI-Generated Content Disclaimer
- Sentence analysis, translation and correction suggestions, transcription results, and conversational replies are generated automatically by an AI model (Google Gemini) and may be inaccurate or inappropriate.
- The Service makes no warranty as to the accuracy, completeness, or fitness for a particular purpose of AI-generated output.
- You should verify AI output rather than relying on it as-is, and you are responsible for any consequences of relying on it.
- The same input may produce different results on different attempts; this is expected behavior, not a defect.
7. Paid Services
The current release offers no paid subscription and no in-app purchases; all features are free to use. To manage server costs, AI features are subject to a daily usage limit, which may be adjusted without prior notice. If paid services are introduced in the future, separate terms and a payment and refund policy will be provided in advance.
8. Changes to and Interruption of the Service
- The operator may improve or change the Service. Material changes will be announced within the Service or on this page.
- The Service may be suspended in whole or in part for maintenance, faults, or unavoidable causes such as outages or policy changes at external providers (for example, Google Gemini, Firebase, or Vercel).
- The operator may discontinue the Service and will give reasonable advance notice if it does.
9. Limitation of Liability
- The Service is provided "as is," with no warranty of uninterrupted or error-free operation.
- The operator is not liable for damages caused by events beyond its control, such as natural disasters, network failures, or outages of external services.
- The operator is not liable for loss of learning data resulting from use of guest mode, clearing browser data, or account deletion.
- The operator is not liable for disputes or damages arising from content you submit or upload.
- Except in cases of the operator's intent or gross negligence, the operator is not liable for indirect, incidental, or special damages arising in connection with this free Service.
10. Privacy
Collection, use, retention, and deletion of personal information are governed by our Privacy Policy. The Service is not directed at children under the age of 14.
11. Changes to These Terms
The operator may revise these Terms as needed. Revised Terms take effect when posted on this page. If you do not agree to a revision, you may stop using the Service and delete your account.
12. Governing Law and Disputes
These Terms are governed by and construed under the laws of the Republic of Korea. Any dispute arising in connection with the Service will first be addressed through good-faith discussion between the parties; if no agreement is reached, it may be brought before the court having jurisdiction under the Korean Civil Procedure Act.
